The German Federal Financial Supervisory Authority (Bundesanstalt für Finanzdienstleistungsaufsicht – BaFin) launched a consultation (to run until 23 August 2019) on a draft circular specifying the supervisory procedure with regard to the application of Article 23 of the amended Delegated Regulation (EU) 2015/61 and the corresponding provisions in the Reg (EU) No. 680/2014, as amended by the Reg (EU) 2016/322, on additional outflows of liquidity in connection with other products and services that do not fall under the outflow categories of Articles 27 to 31a. The categories of products and services listed in Article 23 (1) a) to h) and the categories of products and services listed in this context in the Reg (EU) 2016/322 are defined in more detail and the outflows of liquidity attributable to these products and services are determined. Furthermore, the reports on the products and services covered by Article 23 (1), for which the probability and potential extent of liquidity outflows are significant, to be carried out at least once a year pursuant to Article 23 (2), as well as the definition of the liquidity outflows to be allocated to these products and services, are specified.
